If a planning authority received critical representations from statutory consultees, would your client’s application for planning permission automatically fail?

The LPA will assess the recommendations of the consultees but it is ultimately their own opinion that matters in the outcome. LPAs would generally respect the consultees’ advice as they are considered the experts on their field but they might also argue on the benefits of the development against the negative impacts. The LPA would inform the developer about the consultees raised issues and will possibly try to iron them out before making a final decision.
