If there’s a claim against a consultant on the grounds of professional negligence, there are certain things that need to be avoided and any response to the claim needs to get past the PII insurers.

First of all the consultant should not respond in writing on anything that is relative to the claim and contact the PII insurers. They would be able to provide guidance on the appropriate handling of the claim and the type of information that should be shared at each stage of the claim.

Further investigation will then follow to establish the reason(s) why the incident that led to the claim occured. If there is no straight-forward result to the Landscape Architect’s investigation as there are other professionals/disciplines/contractors involved, the investigation should include how others implemented the information provided by the Landscape Architect’s technical drawings and documents.
